I-TryIt Buyers Club Terms and Service
I-Try It™ and I-TryIt.com is owned and operated by Hear and Know, Inc. (dba Pure Zing). All trademarks and or copyrights are the property of their respective owners.
Member Agreement
I-TryIt Buyers Club membership is a trust and an entitlement earned by member’s agreement to provide a written product review for each I-TryIt product purchased, where each review must be submitted to the I-TryIt website. Membership is also an entitlement based on the ongoing good conduct and best intentions of each club member.
Membership includes certain requirements and obligations. These include:
(1) Only U.S. residents 21 years of age or older may join the I-TryIt Buyers Club.
(2) Club Members will only receive the discount if the purchase is in their own name. If payment is made by credit card, the name on the card must match the name of the Buyers Club Account.
(3) Members who purchase an I-TryIt product are expected to provide a written product review for each unique purchased I-TryIt product. This review will be published on the I-TryIt website. Each I-TryIt Buyers Club member will receive reminder notices to supply their review post purchase of a product. After 15 days post delivery of a product purchased, if no written review is submitted to the I-TryIt website, a member’s privilege to purchase another I-TryIt product will be suspended until the overdue product review is provided.
(4) In posting content or submitting material, and unless we indicate otherwise, you grant Pure Zing a nonexclusive, royalty-free, perpetual, irrevocable, and fully sub licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant Pure Zing and any sub licensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Pure Zing for all claims resulting from content you supply. Pure Zing has the right but not the obligation to monitor and edit or remove any activity or content. Pure Zing takes no responsibility and assumes no liability for any content posted by you or any third party.
(5) All products purchased on the I-TryIt website are for personal use only, not for commercial use or resale. Members are expressly prohibited from purchasing I-TryIt products solely for their own commercial purposes and gain. This includes, but is not restricted to, reselling I-TryIt purchases within retail stores or online websites, including offering them for promotional purposes related to a commercial, sweepstakes, giveaway, fund-raising or any other revenue-generating activity either through themselves directly or via transfer to third-party providers and partners.
If, in the sole judgment of Pure Zing management a member's behavior in any way, at any time, or in any place is detrimental to Pure Zing, I-TryIt or I-TryIt Buyers Club members, the offending member may be restricted in club access or removed altogether from club rolls.
I-TryIt Buyers Club Privacy Policy
The I-TryIt Buyers Club membership program (the “Program”) and the Program web site located at www.I-TryIt.com (the “Site”) are owned and operated by Hear and Know, Inc. (dba “Pure Zing”). By enrolling in the Program and/or using the Site, you agree to the collection and use of your information by us in accordance with this Privacy Policy. If you do not agree with this Privacy Policy, then do not enroll in the Program or use the Site.
Changes to the Privacy Policy
We reserve the right to change the terms of this Privacy Policy. Since any changes will be posted on this page, we encourage you to check this page regularly. Your continued use of the Program and/or Site following any changes to this Privacy Policy will constitute your acceptance of such changes.
Information We Collect
We may collect “personally identifiable information” from you such as your name, postal address, telephone number, fax number and email address. We will collect personally identifiable information from you when you actively give us the information such as when you enroll to become a Program member, when you want to access the Site for the first time or otherwise communicate with the Site. When you join the I-TryIt Buyers Club Program, or use other features on the Site, we request you to provide financial information such as account or credit card numbers. We will use your financial information to bill you for products and services or otherwise process your transactions. By enrolling as a member or making a purchase on the Site, you consent to our providing your financial information to our service providers and to such third parties as we determine is necessary to process your transactions. These third parties may include the credit card companies and banking institutions used to process the transaction.
We may also provide survey questionnaires and track your traffic patterns, benefit usage and preferences in a personally identifiable manner, in order to better service your membership, personalize your service and develop additional benefits that may be of interest to you.
By becoming a Member, you acknowledge that Pure Zing and its Participating I-TryIt vendors may also send you information, samples or special offers it thinks may be of interest to you or other complementary goods offered. If you do not want to receive email communications with third party advertising from the vendors whose products you purchase on I-TryIt.com, do not become an I-TryIt member.
Not for Children
The Program and Site are not intended for use by children. We will not knowingly collect any personally identifiable information submitted by visitors to the Site and/or consumers seeking to enroll in the Program who are under the age of 21.
How We Use Your Information
We will use your personally identifiable information for customer service, to provide you with information that you may request, to identify you as a member, to contact you via postal mail about information we think would be of interest to you, to evaluate and improve our service, and to customize your experience in the Program and/or on the Site. Your personal information is used by us to respond to your requests, process your transactions on the Site, tailor offerings to you and send you information about membership benefits and/or your transactions on the Site.
We may also use your personally identifiable information to email you with information we think you would be interested in, unless you notify us that you no longer want to receive these communications. Email messages will provide you with an opportunity to opt-out of receiving this information. Please note that changes to your preferences may not be effective immediately.
We use third party contractors to help us operate our business, the Program and the Site or administer activities on our behalf, such as authorization of credit card transactions and provision of membership benefits, and may share your information with these contractors for those purposes.
We share your information with third party benefit providers and third party retailers so that you can use the services and benefits when you choose to do so. We may share your information, along with the transactions you’ve conducted using your membership, with third party retailers and benefit providers for their tracking and internal purposes. These third party retailers and benefit providers may use your personally identifiable information to market offers directly to you.
We use non-personally identifiable information for internal purposes and to help us interact with visitors to the Site. We may also share non-personally identifiable information in the aggregate form with third parties to illustrate trends and patterns.
If Pure Zing is sold to, or merges with, another company, or declares bankruptcy, some or all of the information collected from you may be transferred to a third party as a result of the transfer of assets. We may also disclose your information when we determine it is necessary to comply with applicable laws or protect the interests or safety of Pure Zing, I-TryIt members or other visitors to the Site.
Miscellaneous
Shipping & Delivery
At this time, we ship to the mainland U.S. only. We reserve the right to sell into other regions when we feel the opportunity, cost, and potential risk is reasonable. Accepted carriers such as USPS, UPS, and Fed-Ex are normally used by the Vendors and by Pure Zing.
Some of I-TryIt offered products are warehoused and shipped by participating vendors around the U.S. Their policies are normally: shipment within seven days. If we have your product on hand at Pure Zing, we ship within three business days.
Sales Tax
Pure Zing charges sales tax for merchandise ordered by a New Mexico credit card address.
Return Policy
You may purchase merchandise from the I-TryIt Web site by using Visa or MasterCard. Pure Zing reserves the right to change its payment procedures at any time without prior notice to you. Due to the greatly reduced price of the products available on I-TryIt, plus the nature of the site offering products for trial to determine suitability to purchasers, all sales will be considered final except in the following instances:
- We refund the price (for the amount posted on I-TryIt) plus shipping fee if the product is not what the buyer ordered/purchased and the product packaging remains unopened. We must be notified immediately after delivery of this type of shipping error.
- If the product is delivered to the buyer damaged, please retain the shipping package and its contents and contact the carrier as well as us. In many cases, we can also offer product exchanges in lieu of a refund, so contact Pure Zing as soon as possible to determine your options as a valued customer.
Links The Site contains links to other sites, including, among others, PureZing.com, those of advertisers, third party retailers, and other third parties and companies whose trademarks may appear on the Site. We are not responsible for the information collection practices or the content of the sites to which we link. The information you provide to these parties are not subject to our Privacy Policy. We encourage you to read the privacy policies of these sites before you submit any information to them.
Community Functions The Site may make available to third parties its users comment areas, chat rooms, forums, message boards, and/or other community functions. Remember that any information you disclose in these areas becomes public information and you should exercise caution when deciding to disclose your personal, financial or other information. You should use such community functions at your own risk.
Security Protecting your information is important to us. We use the industry standard technology to protect the security of your information. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we are committed to protecting your information, we cannot ensure or warrant the security of any information you transmit to us.
DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY, SITE OPERATIONS: This site and all information, content, materials, products (including software) and services included on or otherwise made available to you through the I-TryIt site are provided by Pure Zing on an “AS IS” and “As Available” basis, unless otherwise specified in writing. Pure Zing makes no representations or warranties of any kind, express or implied, as to the operation of this site or the information, content, materials, products (including software) or services included on or otherwise made available to you through this site, unless otherwise specified in writing. You expressly agree that your use of this site is at your sole risk.
VOID WHERE PROHIBITED: Although the information on this Web site is accessible worldwide, not all products or services discussed in this Web site are available to all persons or in all geographic locations or jurisdictions. Pure Zing reserves the right to limit the provision of their products or services to any person, geographic area, or jurisdiction they so desire and to limit the quantities of any products or services that they provide. Any offer for any product or service made in the materials on this Web site is void where prohibited.
GOVERNING LAW: In the event of litigation both parties agree that the Law of New Mexico shall apply and both parties consent to the jurisdiction of the state courts of New Mexico, or in the event of diversity of citizenship, the United States District Court for the (District). Both parties expressly waive a trial by jury.
The Terms and Conditions constitute the entire agreement between you and Pure Zing with respect to the I-TryIt Web site. The Terms and Conditions supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written between you and Pure Zing with respect to this Web site. No modification of the Terms and Conditions shall be effective unless it is authorized by Pure Zing. If any provision of the Terms and Conditions is found to be contrary to law, then such provision(s) shall be constructed in a manner to closely reflect, as much as possible, the intentions of the parties, with the other provisions remaining in full force and effect.
